Finding that unusual circumstances must exist before a court can order a plaintiff to undergo multiple independent medical examinations, a Pennsylvania judge has shot down Weis Markets’ efforts to have a woman undergo two exams by different orthopedic specialists.

Lackawanna County Court of Common Pleas Judge Carmen Minora recently ruled in Christian v. Weis Markets that the defendant’s request to have the plaintiff undergo separate medical examinations by two orthopedists, one specializing in treating hands and the other specializing in sports medicine, would be cumulative and duplicative.
