A lawsuit brought by two agents of the Office of Attorney General, in which they claim Kathleen Kane retaliated against them for giving grand jury testimony, has survived motions to dismiss in federal court.

U.S. District Chief Judge Christopher C. Conner of the Middle District rejected the defendants’ argument that Michael Carlson and Michael Cranga were not protected by the First Amendment when they testified before a grand jury in Philadelphia. Conner denied the motions in an order filed Wednesday and made publicly available Thursday.
