A group of 41 insurance companies that purchases billions of dollars in adulterated drugs from GlaxoSmithKline can proceed with their Racketeering Influenced and Corrupt Organization Act case against the pharmaceutical giant.

U.S. District Judge Juan R. Sanchez of the Eastern District of Pennsylvania denied GSK’s motion Wednesday to dismiss the insurers’ claims. GSK argued that Blue Cross Blue Shield Association and 40 other insurance companies lacked standing to bring the case because they didn’t show an injury to their businesses or property.
