A SEPTA employee fired after she was seen at a taping of the “Live With Kelly & Michael” television program while on sick leave will not be able to revive her hostile work environment and discrimination claims against the transportation authority, a federal appeals court has ruled.

A three-judge panel of the U.S. Court of Appeals for the Third Circuit ruled Monday to deny the appeal of plaintiff Marie Selvato after her claims were tossed on summary judgment last year. U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania had granted summary judgment to the Southeastern Pennsylvania Transportation Authority in October, finding that Selvato failed to show her termination was connected to her sexual harassment allegations.
