As lawsuits have begun to mount against Wendy’s over its recently disclosed data breach, several financial institutions that filed proposed class action suits in Pennsylvania federal court have asked that the cases be consolidated.

First Choice Federal Credit Union, which, in April, was the first to sue the fast-food chain over a data breach that was disclosed earlier this year, has asked the U.S. District Court for the Western District of Pennsylvania to consolidate its proposed class action lawsuit with four other actions pending in the district. Those cases were all filed between June 15 and June 20—after Wendy’s disclosed that the number of franchises affected was “considerably higher” than 5 percent.
