The decision over whether Penn State can immediately bring to the state Superior Court its fight for insurance coverage for the sex abuse by Jerry Sandusky lies in the hands of one Philadelphia judge. But, according to attorneys who practice in the insurance arena, the possible appeal raises a series of novel questions.

Earlier this month, Penn State filed a motion requesting interlocutory appeal from a ruling by Philadelphia Court of Common Pleas Judge Gary Glazer in Pennsylvania Manufacturers’ Association Insurance v. Pennsylvania State University.
