A New Jersey appeals court has struck down the state’s system of transferring youthful offenders from juvenile facilities to adult prisons without affording them basic due process.
The Appellate Division on Tuesday ordered the Juvenile Justice Commission to rewrite its regulations so that transferees are afforded prior written notice, a hearing before an impartial decision-maker, written findings of fact and some form of representation.
