In an apparent case of first impression, the Commonwealth Court has determined that it has the authority to use the more liberal de novo standard of review when hearing appeals regarding requests to access governmental information under Pennsylvania’s Right-to-Know Law.

The case was decided by a five-judge panel of the court, including President Judge Bonnie Brigance Leadbetter and Judges Dan Pellegrini, Renée Cohn Jubelirer, Robert Simpson and Johnny J. Butler. Simpson wrote the opinion issued Feb. 5.
