A Court of Common Pleas judge has ruled in a case of first impression that members of the judiciary — not arbitrators — are responsible for deciding disputes over the scope of arbitration clauses unless a contract explicitly states otherwise, but that arbitrators remain responsible for determining the validity of a contract as a whole.

To support his decision, Allegheny County Common Pleas Judge R. Stanton Wettick Jr. relied on several U.S. Supreme Court cases, including First Options of Chicago, Inc. v. Kaplan, 514 U.S. 938 (1995) and AT&T Technologies, Inc. v. Communications Workers, 475 U.S. 643 (1986).
