The Pennsylvania Supreme Court has agreed to address questions regarding whether presumption of paternity is still a valid legal theory.

In a May 21 order, the high court granted allocatur in Sitler v. Jones, looking to answer whether the Superior Court erred in affirming the dismissal of Steven M. Sitler’s complaint “because the public policy behind the presumption of paternity—the Commonwealth’s interest in protecting family unity—does not outweigh the child and alleged biological parent’s rights and interests?”
