The Pennsylvania Supreme Court has agreed to address questions regarding the sexual abuse exception to the Local Political Subdivision Tort Claims Act and whether the state is immune to sexual abuse lawsuits when the plaintiffs were not minors when victimized.

In an April 8 order, the high court granted allocatur in City of Philadelphia v. J.S., limiting arguments to the single issue of “Whether the Commonwealth Court incorrectly concluded that the Sexual Abuse Exception to the Local Political Subdivision Tort Claims Act (42 Pa.C.S. § 8542(b)(9)) is only applicable to plaintiffs who were minors at the time they were victimized?”
