The Pennsylvania Supreme Court has agreed to examine whether a federal statute restricting lawsuits against gun manufacturers unconstitutionally encroaches on states’ authority to govern tort law.

The justices granted a petition for appeal Tuesday on three questions surrounding the Protection of Lawful Commerce in Arms Act of 2005 in a products liability suit. Two deals with the statute as it relates to the particular case on appeal, captioned Gustafson v. Springfield, while the third takes a look at whether the act can control Pennsylvania law at all.
