Plaintiffs lawyers are taking another shot at creating multidistrict litigation over insurance claims tied to the COVID-19 pandemic, with two requests set for arguments in December.
So far, attempts to coordinate cases against insurance firms have had mixed results before the U.S. Judicial Panel on Multidistrict Litigation. The panel has refused to coordinate hundreds of business interruption cases against dozens of companies, but later granted one MDL against a single insurer, Fond du Lac, Wisconsin-based Society Insurance. Lawyers leading the Society cases are now focusing their efforts on two dozen cases brought against Erie Insurance of Pennsylvania.
