Last year, Berry served as the lead lawyer in one of Philadelphia’s highest-profile media cases, Peruto v. Roc Nation. In that case, he defended Amazon in claims arising from the production of a documentary series about rapper Meek Mill’s long-running battle with the city’s criminal justice system. Mill’s case sparked public outrage after the presiding judge sentenced him to prison for a probation violation. As the controversy over the judge’s handling of Mill’s case grew, the judge hired well-known defense lawyer Charles Peruto Jr. to speak on her behalf and he was interviewed for the Amazon documentary. Following his on-camera interview, Peruto criticized his client for her handling of Mill’s case while the microphone was still on. After a recording of his comments was published, Peruto sued, claiming he had been illegally wiretapped and he sought to recover the recording and block its further dissemination.

Berry successfully represented Amazon in defeating Peruto’s claims. The court’s ruling granting summary judgment for Amazon and the other defendants set important precedents about the law governing when a source’s statements to reporters are “off the record” and the reasonableness of a source’s expectation of privacy in off-camera conversations with filmmakers and other journalists.
