The Pennsylvania Superior Court has upheld a lower court’s decision to not seal a settlement agreement in a minor’s medical malpractice lawsuit.

A three-judge panel in A.A. v. Glicken, consisting of Judges Judith Olson, Alice Dubow and Maria McLaughlin, rejected an argument by defendants Lehigh Valley Hospital and related entities that not sealing the settlement agreement in a lawsuit stemming from the negligent circumcision of a newborn would have a chilling effect on future settlements and go against the parties’ interest in privacy.
