Pointing to vagaries in the landmark Pennsylvania products liability ruling, Tincher v. Omega Flex, a federal judge has granted one strict liability claim and dismissed another in a defective hip implant lawsuit.

U.S. District Judge Wendy Beetlestone of the Eastern District of Pennsylvania granted defendants Howmedica Osteonics Corp. and the Stryker Corp.’s motion to dismiss plaintiff Gary Smith’s strict liability design-defect and negligence claims.
