A health center and the staffing agency that vetted its contractors are not liable for a home health care worker’s assault of a child, the state Superior Court has ruled.

A unanimous three-judge panel affirmed a Philadelphia Court of Common Pleas ruling in a Sept. 9 memorandum opinion, holding that the appellants failed to demonstrate any negligence in Staffmore LLC’s hiring or Philadelphia Mental Health Center’s supervision of Emmanuel Opawumi.
