In his bid to get Bailets v. Pennsylvania Turnpike Commission reinstated, attorney James J. West, who represented Ralph M. Bailets, argued that the court failed to properly consider the affidavit of a former chief of staff at the commission who raised concerns about the conduct there.

West contended that, among other things, people at the company had been hired into unnecessary positions, and that there was no transfer of information from the company to the commission regarding how to use the new computer system. He claimed Bailets had been fired for reporting the waste.
