Pennsylvania Attorney General Kathleen Kane’s challenge to the appointment of a special prosecutor in the grand jury leak case possibly pending against her wades into a relatively uncharted area of the law, according to some legal observers.

On Feb. 4, Kane filed a supplemental memorandum supporting her challenge to supervising grand jury Judge William R. Carpenter’s appointment of a special prosecutor to investigate Kane’s office for alleged leaks of confidential grand-jury information. Documents unsealed last month showed the grand jury had recommended Kane be charged with perjury, false swearing, official oppression and obstruction.
