A Lawrence County judge has said that a claim of intentional infliction of emotional distress may move forward against Jameson Memorial Hospital and one of its doctors, despite the defendants’ argument that the claim has not been recognized by the state Supreme Court.

Judge J. Craig Cox overruled several preliminary objections in Young v. Jameson Memorial Hospital regarding Patricia Young’s counts of negligent and intentional infliction of emotional distress, as well as her claim for punitive damages. While the Pennsylvania Supreme Court has yet to recognize the intentional infliction claim, the Superior Court has done so, he said.
