After he was sanctioned for using a pretrial telephone survey to influence a Lubbock jury pool, a prominent Dallas lawyer is urging an appeals court to overturn his punishment by arguing that the litigation tactic amounted to legitimate research.

William A. Brewer III, of Dallas’ Brewer Attorneys & Counselors, was sanctioned in January by 72nd District Court Judge Ruben Reyes, who found that Brewer was responsible for conducting a poll over issues in Teel v. Titeflex. In that case, Brewer defended Titeflex, a company accused of manufacturing faulty flexible gas tubing that allegedly caused a deadly house fire.
