The plaintiff in the first bellwether case in the massive hip replacement device multidistrict litigation against Johnson & Johnson filed a response to the company’s motion seeking a final judgment.

In the response, filed on Oct. 23, the plaintiff argues that the company’s motion violates a stay order imposed by the court. And the plaintiff seeks a court declaration stating that. Alternatively, the plaintiff asks the court to order a stay on the case until “the conclusion of the bellwether process.”
