Driver sideswiped by tired trucker recovers $2.9 million

A driver who claimed neck and back injuries in a sideswipe with a tractor-trailer recovered $2.9 million on Oct. 29, 2014. Krista Dillon was driving her sedan on an interstate when a tractor-trailer for Joe Tex Xpress allegedly changed into her lane and struck her driver side. Plaintiff’s counsel argued this was due to driver fatigue, and the truck driver made inaccurate entries into his log books to conceal the amount of time he had driven before the collision. Plaintiff’s counsel argued his employer was grossly negligent for failing to properly train him. The jury found gross negligence and awarded $4.1 million, but the court reduced the punitive damages from $3 million to $1.8 million.
