No finding of age discrimination

On Oct. 30, a jury sided with a company that was sued for age discrimination. Todd Martin, 45, was demoted from branch manager to sales representative at the Hartley office of Helena Chemical Co., a Tennessee-based agricultural products corporation. Plaintiff’s counsel argued that a 36-year-old employee was promoted to replace him, and the regional manager allegedly stated during a meeting with Martin that the company wanted a younger man to be the manager. Plaintiff’s counsel argued the demotion left Martin with no choice but to leave his position. Defense counsel argued Martin was demoted for business reasons. Martin had an excellent sales record but he had failed to perform many of his managerial duties, such as hiring needed employees, ensuring proper training and maintaining the branch office building, counsel argued.
