When a defendant gets hit with punitive damages, they usually want Texas law to apply, given the tort reform nature of those statutes.

And David Lynch recently convinced Houston’s First Court of Appeals that the Lone Star State’s law should also apply to an insurance coverage dispute—a ruling that may prevent his client from paying $1.5 million in out-of-pocket expenses for a punitive damage judgment its insurance company refuses to pay.
