Passenger in shuttle van fell, but driver not to blame

On April 16, a jury declined to award damages to a woman who claimed that she was injured when she fell in a hotel shuttle van. Michelle Gresham was in a van for Holiday Inn On-The-Beach. The driver was about to make a left turn when the car ahead of him stopped and he hit his brakes. Gresham fell to the floor. She fractured her arm. The defense argued that Gresham was standing, as stated in the emergency room records. Davidson said he told her repeatedly to sit down, but that she was too drunk to comply. He said she was being loud and obnoxious, she stumbled into him and she smelled of alcohol. The defense called a toxicologist, who said Gresham’s behavior was consistent with physical, mental and cognitive impairment from alcohol.
