Doctor not to blame for patient’s ankle problems, jury finds

On Nov. 1, 2013, a jury sided with an orthopedic surgeon who was accused of misaligning a patient’s foot during a revision of an ankle fusion. Dr. Robert Shackelford performed the procedure on Delona Drews. She claimed that the doctor wasn’t qualified to perform the procedure because he had never done it before. Plaintiff’s counsel maintained that Shackelford fused the ankle in a plantar flexion position instead of the standard 90-degree neutral position. As a result, her gait is severely altered, she claimed. Defense counsel maintained that Shackelford released Drews with strict orders not to put her full weight on the foot, only to discover at her last office visit that she had been, and this noncompliance was the proximate cause of her injuries.
