A special court of review had more questions than answers when it heard Texas Court of Criminal Appeals Presiding Judge Sharon Keller’s motion to dismiss the State Commission on Judicial Conduct’s charges and public warning of her. But the three-member court of review plans to issue a decision on the motion by Oct. 8.

Chief Justice Terrie Livingston of Fort Worth’s 2nd Court of Appeals, who presides over the special court reviewing Keller’s case, announced the decision deadline following a Sept. 20 hearing on Keller’s motion. Livingston’s announcement came after the justices heard arguments on the motion, which challenges the commission’s authority to issue its July 16 public warning of Keller for her conduct in the case of a condemned man.
