Acquitted in January in an aggravated sexual assault case, a northeast Texas attorney and his wife are asking a state court to require the man who prosecuted them to show cause why he should not be held in contempt of court for allegedly violating an expunction order. But the prosecutor, Red River County Attorney Val Varley, denies the couple’s allegations in his original answer filed Dec. 7.

In their original petition in In Re: Lesher, et al., filed Nov. 9 in the 296th District Court in Collin County, Mark and Rhonda Lesher allege that Varley violated a Feb. 24 order granting the Leshers’ petitions for expunction of all records and files pertaining to their arrest. They allege Varley violated the order by sharing statements made by Robert McCarver, who was the Leshers’ co-defendant in the aggravated sexual assault case, that allegedly implicate the Leshers in criminal activity.
