On April 23, a jury found that an oil drilling company wasn’t to blame for a boating accident that injured two brothers. In 2006, James Ervin and Donald Ervin were traveling in East Galveston Bay when their fishing boat allegedly struck a metal pipe just below the waterline. The incident occurred near a platform owned by Masters Resources LLC. The brothers said the impact knocked them unconscious and sent Donald Ervin overboard. When they came to, they reportedly moved the boat off the object, returned to the marina and took themselves to the hospital. Both men sustained severe lacerations and bruises. James Ervin also had two herniated disks, and Donald Ervin injured his hip. They blamed Masters Resources, alleging it failed to keep the water surrounding its platform free of debris. Masters Resources argued that the brothers never located the alleged pipe and couldn’t prove that the company owned, maintained, placed or controlled the object they hit.
