The Texas Supreme Court has agreed to weigh in on a third-party standing question involving Illinois National Insurance Co. and two plaintiffs trying to collect on a $220 million claim.

The warring parties are at odds over the state’s “no direct action” rule, which holds that until a final decision on an underlying liability occurs, a third-party plaintiff has no ripe claim.
