Resurrecting a lawsuit that drew national attention, a federal appellate court ruled that a high school coach who directed players to assault a referee for alleged racial name-calling was acting in his official capacity.

Although the plaintiff’s claim against a San Antonio school district was dismissed, it is nevertheless affected because a panel of the U.S. Court of Appeals for the Fifth Circuit found the former John Jay High School assistant football coach was a state actor.
