A Texas appellate panel has sided with a voter who was sued by a failed 2018 Polk County District Court judicial candidate for allegedly violating state election law by spending more than $3,000 endorsing the candidate who ultimately won.

After losing the election, 258th Judicial District Court judicial candidate John Wells III, sued Charles Von Schmidt, an individual voter. According to the appellate panel’s opinion, Wells alleged Von Schmidt violated the Texas Elections Code by spending $3,279.32 on newspaper advertisements and mailers endorsing Wells’ opposing candidate, Travis Kitchens, which exceeded the $1,000 contribution limit based on the district’s population.
