Three donors to the Texas A&M University 12th Man Foundation filed a class action and motion for a temporary injunction against the organization, seeking to stop the reassigning of seats to ticketholders at Kyle Field, the university’s athletic stadium.

In their suit, York v. Texas A&M University Foundation, filed in the Eastern District of Texas, the plaintiffs allege that when they were solicited for donations, they were promised lifetime benefits that included tickets to all Texas A&M home football games in the “best available” seating locations, as well as parking and other benefits. But since 2005, the complaint alleges, the foundation, which ranks as one of the nation’s top athletic scholarship funds, has been “eroding” those donor benefits.
