Essex Insurance Co. v. Eldridge Land, L.L.C.

Because the commercial property insurance policy at issue excluded damage caused by or resulting from theft, the evidence established that all damage above the amount of the policy deductible was caused by or resulting from theft, and no exception to the theft exclusion applies, the trial court erred in holding that the policy provided coverage for the stipulated damage. OPINION

Inthis cause, we are called upon to interpret provisions in a commercialproperty insurance policy concerning vandalism and damage from theft. Although courts in other jurisdictions have addressed substantially similar provisions, arriving at conflicting results, this is the first Texas appellate case to raise these precise issues.
