In a suit over whether Goldman Sachs should have to foot the legal bill for a former computer programmer who was charged with stealing computer code from the company, the parties have accused each other of trying to game the system in an attempt to keep the case in their preferred forum.

The forum dispute in Aleynikov v. Goldman Sachs Group centers on a question of statutory interpretation that has split federal judges: Can a sole defendant sued in its own state legally circumvent the forum-defendant rule by removing the suit to federal court before being served with the complaint?
