A motorcyclist who lost his leg after colliding with a guardrail on what he claimed was a defective roadway was paid $2.5 million on May 1 to settle his suit, Smetana v. New Jersey Department of Transportation.

In May 2012, James Smetana, 51, was riding on Route 23 in West Milford, travelling around a right curve, when he lost control of the motorcycle, slid off the left-hand side of the road and struck a guardrail. Smetana’s left leg was amputated and couldn’t be saved. He now uses a prosthetic but is totally disabled and unable to return to work as a mail carrier, his suit claimed.
