Both sides in a 15-year-old legal malpractice suit against defunct law firm Carpenter, Bennett & Morrissey are urging a federal judge in Newark not to send the case back to state court.

U.S. District Judge Madeline Cox Arleo of the District of New Jersey asked the parties on Jan. 30 to show cause why she should retain supplemental jurisdiction in the case now that all federal issues have been resolved. Lawyers for the two remaining plaintiffs, for Carpenter Bennett and for the two lawyers who are named defendants in the case, have all responded that the considerable time and resources they have expended in federal court should weigh against a remand.
