With his trial on racketeering charges set for Feb. 10, former Bergen County Democratic Organization Chairman Joseph Ferriero has moved for dismissal of the case, claiming U.S. Attorney Paul Fishman of the District of New Jersey represented two key figures in the case while in private practice.

Ferriero said in court documents filed Feb. 2 that Fishman represented James Dausch, an executive of Mills Corp., in connection with his testimony before a grand jury in 2008. Ferriero’s indictment charges that he received $1.7 million in bribes from Dausch to secure approval of a Mills Corp. retail and entertainment project in East Rutherford, N.J.
