A former Goldman Sachs & Co. vice president has lost his second motion to compel the company to advance him legal fees for the defense of a criminal case.

Plaintiff Sergey Aleynikov’s claim that corporate officers are entitled to advancement of legal fees under the public policy of Delaware, where Goldman Sachs is incorporated, was rejected by U.S. District Judge Kevin McNulty of the District of New Jersey. McNulty, sitting in Newark, said an award of summary judgment on the public policy basis is outside the scope of the remand of the case by the U.S. Court of Appeals for the Third Circuit.
