The New Jersey Supreme Court is considering whether defendants in civil actions brought under the state’s Insurance Fraud Prevention Act (IFPA) have the right to a trial by jury.

A lawyer representing dozens of defendants in such a case, filed against them by inter-related insurance carriers, asked the court on Jan. 5 to overturn an Appellate Division ruling that said that because the IFPA is a statute of equity, no right to a jury trial attaches.
