ESTATE OF MIYANO HIRAKI, Deceased (15-3202/B) — The decision dated January 26, 2022, is hereby vacated and replaced with the following decision: This is an application to withdraw funds on deposit with the State Comptroller for the benefit of the unknown distributes of Miyano Hiraki. Based upon the proof submitted before a court attorney-referee, the court finds that decedent was survived by one brother and four sisters as her sole distributees. The court is satisfied that diligent and exhaustive efforts have been made, without success, to determine whether other distributees exist, that more than three years have passed since decedent’s death, and that no claim to a distributive share in the estate has been made by any person other than the above-mentioned distributees. It is therefore determined that no distributees exist other than those established in the record before the court (SCPA 2225). Accordingly, the Comptroller of the State of New York, after deducting his fees and charges as provided by law, is directed to pay the funds on deposit, plus accrued interest, to John C. Fisher, Esq., as attorney-in-fact for Yutaka Shigehisa, Haruno Takeshita, Kaoru Yamanoto, Chizuno Kojima, and Sueno Shigehisa, to be distributed to them in equal shares (EPTL 4-1.1). Decree signed.
