ESTATE OF SANDRA A. VUOTO, Deceased (19-3735/A) — In this accounting proceeding by the Public Administrator, the court is asked to determine the identity of decedent’s distributees. Based upon proof submitted at a kinship hearing held on September 14, 2022, before a court attorney-referee, the court finds that decedent, Sandra Ann Vuoto, was survived by two maternal first cousins, Raymond Barbieri, and Robert Barbieri, as her sole distributees. The court is further satisfied that diligent and exhaustive efforts have been made, without success, to ascertain the existence of paternal distributees, that more than three years have elapsed since decedent’s death, and that no claim to a distributive share in the estate has been made by any person other than the aforesaid distributees (SCPA 2225 [b]). Therefore, the court determines that no distributees exist other than those whose status has been established on this record. Accordingly, the net estate shall be distributed to Raymond Barbieri and Robert Barbieri, in equal shares (EPTL 4-1.1[a][6]). The Public Administrator shall supplement her account by affidavit and, as so supplemented, the account is settled. Settle decree with a provision for compensation to the guardian ad litem.
