Decision & Order decided on: December 21 & 22, 2022 Surrogate Anderson ESTATE LESTER ISAACS Deceased (18-1491/A) — In this proceeding to determine the validity of a claim in the estate of Lester Isaacs, the court issued a decision and order on August 8, 2022 (the “August 8, 2022 Decision”), stating that the proceeding would be dismissed for failure to prosecute unless a motion for summary judgment or a note of issue was filed within 90 days of the date of the decision. The Clerk of the Court sent a copy of the decision to counsel of record by certified mail, but neither petitioner nor respondent sought to prosecute this matter as set forth in the August 8, 2022 Decision. Accordingly, since more than 90 days have passed, the petition is dismissed, without prejudice, for failure to prosecute (SCPA 209 [8]; CPLR 3216). This decision constitutes the order of the court. Dated: December 22, 2022

ESTATE OF RUTH SIEGEL, Deceased (16-4434/A) — In this miscellaneous proceeding to determine the validity of a claim (SCPA 1809), petitioners, the executors of the estate of Ruth Siegel, brought a motion for summary judgment seeking to disallow the claim, and respondents (creditors) opposed the motion and cross-moved for summary judgment in their favor. At the call of the calendar on July 28, 2022, the court directed the parties to attend mediation. Accordingly, the court noted that the motion and cross-motion would be held in abeyance until the conclusion of the mediation session. This decision constitutes the order of the court. Dated: December 22, 2022
