ESTATE OF CARMEN FERNANDEZ, Deceased (20-848/A/B/C) — This court grants this uncontested petition by the Administrator of decedent’s estate for leave to collect and account for the proceeds of an award by the September 11th Victim Compensation Fund (the “VCF,” as authorized by Pub L 111-347, 124 Stat 3623 [2011], and further authorized by Pub L 116-34, 133 Stat 1040 [2019] [the "9/11 Acts"]). Decedent was in the “exposure zone” as defined by the 9/11 Acts and developed a malignant neoplasm of the colon with metastases which caused her death. Petitioner’s request to allocate the gross sum of the award in accordance with the VCF Award Detail is approved. The restrictions on the Letters of Administration are modified to allow this compromise and she is authorized to collect the award proceeds and execute any receipts and releases as may be required. Attorneys fees are fixed and determined at a rate of 10 percent as requested in the petition. Reimbursement for funeral expenses is approved. The net award proceeds shall be distributed as set forth in the decree. Decree settling the Administrator’s account is signed. Dated: May 5, 2022
