ESTATE OF ELEANOR JAFFE, Grantor (14-1678/A) — In this accounting proceeding by Elizabeth Jaffe as Successor Trustee of the Eleanor Jaffe Revocable Living Trust, executed on May 1, 2003, as amended, there has been no action taken since the court removed Ms. Jaffe as Trustee, and directed her to bring her account up to date within a reasonable period of time.1 This accounting was initially filed in August 2014, and remainder beneficiary Mark Jaffe appeared by counsel in February 2015. Prior to Ms. Jaffe’s March 2017 removal as Trustee, the court had issued a Discovery Order. All deadlines established therein have long since expired, but the court never set a deadline for the filing of objections. Court inquiries as to status of this matter have gone unanswered. In view of the foregoing, the court directs as follows: Unless any party files a pleading or a decree in this proceeding by May 13, 2022, the court, exercising its supervisory function, will dismiss the accounting proceeding for failure to prosecute it (SCPA 209 [8]; CPLR 3216; see Bort v. Pepper, 82 AD3d 692,694 [2d Dept 2011]; Koscinski v. St Joseph’s Med. Ctr., 24 AD3d 421, 421-422 [2d Dept 2005]). This decision constitutes the order of the court.
