Surrogate MellaWill of JOHANNA ACKERMAN, Deceased (97-1202/A) — At the call of the April 23, 2019 calendar, upon the default of bailee Salon Marrow Dyckman Newman & Broudy LLC, and on the consent of respondent Edith Wiener, individually and as sole surviving executor of the will of Johanna Ackerman, the court granted the request of petitioner Andrea Spahn Kramer, executor of the will of Laura Spahn, deceased beneficiary under decedent’s will, for a preliminary injunction enjoining the bailee and its successors from delivering the tangible personal property in its possession to Wiener, either as sole surviving executor of decedent’s will or individually, pending a final determination of the petition for a declaration that such property be distributed equally between Wiener, individually, and petitione as executor of the will of Laura Spahn.Notwithstanding Wiener’s default – the order to show cause had directed her to file an answering paper by noon, on April 15, 2019 the court extended Wiener’s deadline for filing verified pleading to April 30, 2019.This decision, together with a transcript of the April 23, 2019 proceedings, constitutes the order of the court. The clerk is directed to mail a copy of this decision to the parties.Dated: April 25 , 2019
