Surrogate MellaESTATE OF JACQUELINE HAEFLINGER, Deceased (14-4063/A/B/C) — The settlement of causes of action for decedent’s conscious pain and suffering and wrongful death was approved, and attorney’s compensation has been fixed by an order of the Supreme Court, New York County, dated February 27, 2017. The administrator has petitioned for leave to allocate and distribute the proceeds of this settlement.The restrictions on the letters of administration issued by this court are removed, and the administrator is authorized to collect the compromise proceeds. Consistent with the order of the Supreme Court, the court also approves the proposed allocation of one hundred percent (100 percent) of the settlement proceeds to the cause of action for wrongful death.1The net proceeds shall be distributed entirely to decedent’s father, Fred Haeflinger, as her sole distributee, pursuant to EPTL 5-4.4 and 4-1.1(a)(4).Decree signed.

Although the February 27, 2017 Order of the Supreme Court directed that “the proceeds of this settlement be allocated entirely to the cause of action for wrongful death,” the same order directs that no payments be made to any distributee until the Surrogate’s Court “has approved the allocation and distribution of the net settlement proceeds.”Dated: April 9, 2019
