Surrogate MellaESTATE OF VINCENT D. CASLIN, Deceased (02/1389/D/E/F) — The application by the administrator of the estate of Vincent D. Caslin to allocate and distribute the net settlement proceeds from causes of action for decedent’s wrongful death and conscious pain and suffering is granted. The causes of action arose from decedent’s exposure to asbestos, and their settlement was approved by Order of the Supreme Court, New York County on December 18, 2017. The same Order approved attorney’s fees and disbursements and directed that the net settlement proceeds be held in an interest-bearing escrow account pending this court’s approval of allocation and distribution of those proceeds.The proceeds are allocated 100 percent to the cause of action for decedent’s conscious pain and suffering. The restrictions contained in the letters issued to the administrator are removed and she is authorized to collect the settlement and execute the necessary receipts and releases with respect to defendants G-I Holdings Prepetition, Robert A. Keasbey Company, Rutland Fire and Clay now being administered through the Rutland Fire and Clay Trust; the restrictions shall remain in full force and effect with regard to any remaining defendants.The net proceeds shall be paid as stated in the Decree.The account is settled and the Decree signed.Dated: January 28, 2019
