Surrogate MellaESTATE OF MARILYN LAMARCHE-MANDELL, A/K/A MARILYN LAMARCHE, Deceased (18/2459/D) — At the call of the calendar on January 8, 2019, the return date of Stephen Mandell’s application for the appointment of the Public Administrator of New York County as the temporary administrator of the estate of his deceased spouse Marilyn LaMarche, the court directed that unless respondent Alison Frank — decedent’s niece and nominated executor under the propounded instrument dated July 27, 2015, and a later testamentary instrument dated September 27, 2017 — files a cross-petition to probate the latter instrument by January 22, 2019, letters of temporary administration will be granted to the Public Administrator of New York County on that date.Additionally, the court directed respondent to file with the court an original testamentary instrument of decedent’s dated October 15, 2015.This decision, together with the transcript of the January 8, 2019 proceedings, constitutes the Order of the court.Clerk to notify.Dated: January 22, 2019
